A "Living Will" is NOT the same as a Will or Living Trust. A Will or Living Trust addresses financial matters related to distribution of assets upon death. A Living Will addresses medical issues. Living Wills instruct health care providers regarding whether or not you want life-sustaining medical care, if you are in a terminal or irreversible condition. Thus, a person should consider executing a Living Will regardless of whether or not they have already executed a Will or Living Trust.
A Living Will covers almost all types of life-sustaining treatments and procedures. A Do Not Resuscitate Order ("DNR") covers only two types of life-threatening situations: 1) cardiac arrest, or 2) respiratory arrest. A DNR order is a document prepared by your doctor at your direction, and is placed in your medical records. Consult your doctor to determine whether or not a DNR is appropriate.
A Living Will cannot go into effect if a woman is pregnant.
